Terms of Use

1. About these terms

Welcome. These Terms of Use ("Terms") are an agreement between you and Fainting Goat Foundation, a Georgia 501(c)(3) nonprofit corporation, operating its vehicle-donation program as Cars Helping Kids. They apply when you use carshelpingkids.org, submit a donation form, request a tax receipt, contact us by phone or text, or otherwise interact with our program. By using the site or submitting a form, you agree to these Terms and to our Privacy Policy.

2. Donating a vehicle

When you submit our donation form or arrange a donation by phone or text:

  • You represent that you are at least 18 years old and that you are the legal owner of the vehicle (or are authorized to dispose of it by the legal owner or an executor).
  • You represent that the vehicle is free of liens, or you will disclose any lien before pickup so we can address it together.
  • You agree that the information you give us — vehicle year, make, model, condition, location, your contact info — is accurate to the best of your knowledge.
  • You agree that we may accept or decline any vehicle in our reasonable discretion (we generally accept cars, trucks, SUVs, vans, motorcycles, boats, and RVs, running or not).
  • You agree to make the vehicle reasonably accessible for pickup at the time you and our towing partner schedule.

3. Title, ownership, and liability

When the towing partner takes possession of the vehicle and you sign the title (or other transfer paperwork) to Fainting Goat Foundation / Cars Helping Kids, ownership transfers to us. From that moment:

  • We become responsible for the vehicle.
  • You should notify your insurance carrier and your state's DMV that you have donated the vehicle, and remove your license plates if required by your state.
  • If your state requires that you file a notice of release of liability, please do so promptly. We are not responsible for tickets, tolls, or violations that occur with the vehicle after we take possession; you are not responsible for them either, provided your notice of release is on file.

If the title is unclear (lost title, deceased owner, salvage title, etc.), tell us upfront. In some states we can still accept the vehicle with a no-title declaration or similar paperwork; in others we cannot. We will let you know either way.

4. Tax deduction

Cars Helping Kids is a program of Fainting Goat Foundation, a 501(c)(3) public charity. Your donation is tax-deductible to the extent allowed by law. The actual amount of your deduction depends on how the vehicle is used or sold:

  • If the gross proceeds from the vehicle's sale are more than $500, you may deduct the gross proceeds from the sale. We will provide you with IRS Form 1098-C showing the sale price.
  • If the gross proceeds are $500 or less, you may deduct the fair market value of the vehicle up to $500, or the gross proceeds, whichever is less.
  • Special rules may apply if we materially improve the vehicle or use it for the charity's exempt purpose. We will indicate this on Form 1098-C if it applies.

5. Consignment program

If you participate in our consignment program (instead of a straight donation), we will handle the sale of your vehicle on your behalf, deduct agreed-upon fees and expenses, share net proceeds according to the consignment agreement we sign with you, and you may deduct only the portion of proceeds you direct to charity. 6. Communications

By giving us your phone number or email, you agree that we may contact you about your donation by phone, text, or email at the contact information you provide. Standard message and data rates apply. You can stop text messages by replying STOP and stop emails by clicking the unsubscribe link. Calls placed to or from 770-871-9422 via a Google Ads call-forwarding number may be recorded for quality assurance, as described in our Privacy Policy.

7. Prohibited uses

You agree not to:

  • Submit false, misleading, or fraudulent donation forms.
  • Attempt to access non-public parts of our website, scrape it at unreasonable rates, or interfere with our hosting infrastructure.
  • Use our website or program to commit a crime, send spam, or violate someone else's rights.

8. Disclaimers

Our website and our information are provided "as is" and "as available," without warranty of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or that any specific result will be obtained. We do not warrant the value of your vehicle or the amount of your tax deduction.

9. Limitation of liability

To the maximum extent permitted by law, Fainting Goat Foundation, its officers, directors, volunteers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our site or our donation program. Our total liability for any direct damages will not exceed the amount, if any, that you paid us in connection with the matter at issue (typically zero, since donation is free).

Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Hall County, Georgia, and you consent to personal jurisdiction there. If any part of these Terms is held unenforceable, the rest remains in effect.

11. Changes

We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest version. Continued use of the site after a change means you accept the updated Terms.
